The state has not adopted source-of-income discrimination protections, but some Florida cities and counties have local ordinances. Voucher Housing in Florida
Florida's voucher housing landscape is administered at the local level:
- Tampa Housing Authority (THA) administers Section 8 in Tampa and adjacent areas
- Miami-Dade Public Housing and Community Development administers Section 8 in Miami-Dade
- Orlando Housing Authority administers Section 8 in Orlando
- Jacksonville Housing Authority administers Section 8 in Jacksonville
- St. Petersburg Housing Authority administers Section 8 in St. Petersburg
Unlike New York, Florida does not have a state-level supplemental rental assistance program like CityFHEPS. Voucher families primarily rely on Section 8, public housing, and select local rental assistance pilots.
Source of Income Protections in Florida
Florida does not have statewide source-of-income protection. This means private landlords in most of Florida can legally refuse to rent to Section 8 voucher holders. However, several Florida localities have adopted source-of-income protections:
- Miami-Dade County has a local source-of-income ordinance
- Broward County has a similar protection
- Tampa does not currently have source-of-income protection (as of our last update)
- Federally-funded properties and project-based Section 8 buildings cannot discriminate against Section 8 holders regardless of state law
If you face discrimination in Florida, document everything and consult with local legal aid organizations. The lack of state-level protection makes voucher housing search in Florida more challenging than in NYC, but voucher-friendly landlord networks exist in every Florida city.
